The purchaser of each lot is deemed to purchase with notice and full knowledge of the important notice to bidders, the Common Auction Conditions, where applicable, the special conditions of sale and this addendum.

The purchaser of each lot is deemed to have inspected the property and have verified the accuracy of all information given in the particulars including the extent of the premises to be sold and the floor areas. Additionally, the purchaser is deemed to have read the legal documentation.

The boundary plans in the auction catalogue are for identification only. The correct title plan showing the boundaries of the properties are available for inspection and the purchaser will be deemed to have purchased with full knowledge thereof.

Please note that vendors may require a supplementary amount to be paid by the purchaser to the vendor over and above the purchase price. Please check the special conditions of sale to ascertain whether this applies to the property for which you are bidding.

The Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 came into force on the 26th June 2017.

Under the Regulations, Acuitus is legally required to immediately undertake customer due diligence checks on the buyer and related parties.

Acuitus will need to receive identification documents that satisfy the Regulations for the bidder, the buyer (if different from the bidder), the beneficial owners with more than 25% of the voting rights or capital and proof of authority if the bidder is acting as an agent.

Acuitus will also need to receive satisfactory identification on the source of the deposit money provided by the bidder/buyer.

If you are the successful bidder, Acuitus requires a separate payment of £1,250+VAT as a buyer's administration charge payable to Acuitus Limited upon exchange of contracts. A VAT receipt will be provided upon payment.

The Common Auction Conditions have been updated as at March 2021.

Please note that the plan indicating the extent of the property demise has been updated (on the website only) to reflect the title plan available in the legal pack. As to the tenancy and accommodation schedule on page 121 of the auction catalogue, please note the following changes: • Unit 5 – The lease term is from 01/04/2016 until 31/03/2017 • Unit 11 (See note 6) – The lease has now completed and has been added to the legal pack. The term is from 14/04/2016 until 13/04/2017. • Unit 8 (See note 3) – The signed renewed lease has now completed and has been added to the legal pack. The term is for 2 years from 01/02/2016 until 31/01/2018 at a rent of £2,250 p.a.x • Unit 12 (See note 4) – The signed renewed lease has now completed and has been added to the legal pack. The term is for 1 year from 06/04/2016 until 05/04/2017 at a rent of £3,100 p.a.x. • Unit 18 (See note 6) – The lease has now completed and has been added to the legal pack. The term is as stated in the auction catalogue. Please note that the tenant is currently benefiting from a rent free period due to expire on 2nd August 2016. The rent of £5,700 p.a.x will become payable on 3rd August 2016. • Unit 23 – The current rent is £3,150 p.a.x and not as stated in the auction catalogue. • The total current rent is therefore £78,713 p.a.x rising to £84,413 p.a.x on 3rd August 2016 (please also refer to Note 7 regarding pay away to Severn Trent Canal) NB: Please note that references to holding over in the tenancy and accommodation schedule mean that the contractual term has ended and the tenant remains in occupation notwithstanding the tenancy agreement is contracted out of the Landlord & Tenant Act 1954 security of tenure provisions. Sandwell Metropolitan Borough Council have stated in key planning policy documents that the site is an allocated residential site by Core Strategy Policy HOU1 and SADDPD Policy H1. It is also designated as part of Regeneration Corridor. Site ref 151 allocated the site for 44 residential units. Ancillary uses (such as retail, community facilities, health facilities) may be acceptable as part of a mixed use residential led development. For further information please refer to the planning documents within the legal Pack. Please note that the auctioneers were unable to gain access to all of the units at the time of inspection.
