ADDENDUM
To the Catalogue for

The purchaser of each lot is deemed to purchase with notice and full knowledge of the important notice to bidders, the Common Auction Conditions, where applicable, the special conditions of sale and this addendum.

The purchaser of each lot is deemed to have inspected the property and have verified the accuracy of all information given in the particulars including the extent of the premises to be sold and the floor areas. Additionally, the purchaser is deemed to have read the legal documentation.

The boundary plans in the auction catalogue are for identification only. The correct title plan showing the boundaries of the properties are available for inspection and the purchaser will be deemed to have purchased with full knowledge thereof.

Please note that vendors may require a supplementary amount to be paid by the purchaser to the vendor over and above the purchase price. Please check the special conditions of sale to ascertain whether this applies to the property for which you are bidding.

The Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 came into force on the 26th June 2017.

Under the Regulations, Acuitus is legally required to immediately undertake customer due diligence checks on the buyer and related parties.

Acuitus will need to receive identification documents that satisfy the Regulations for the bidder, the buyer (if different from the bidder), the beneficial owners with more than 25% of the voting rights or capital and proof of authority if the bidder is acting as an agent.

Acuitus will also need to receive satisfactory identification on the source of the deposit money provided by the bidder/buyer.

If you are the successful bidder, Acuitus requires a separate payment of £1,250+VAT as a buyer's administration charge payable to Acuitus Limited upon exchange of contracts. A VAT receipt will be provided upon payment.

The Common Auction Conditions have been updated as at March 2021.

Lot 48

Potter 1 & Allied Business Centre, Potter Place, West Pimbo Industrial Estate, Skelmersdale, Lancashire, WN8 9PW

Please note that the ‘Rent p.a.’ stated in the catalogue is a gross rent i.e. inclusive of landlords outgoings such as rates, service charge and insurance. A schedule outlining the outgoings is available within the legal pack and has been produced by the managing agents, however, the property is being marketed for sale on behalf of Joint Administrators and therefore no warranties or guarantees in any respect can be given and purchasers must rely solely upon their own enquiries.
The boundary plan in the auction catalogue does not correctly identify the property being offered for sale. Attention should be drawn to the title plans showing the boundaries of the property in the legal pack (and in particular Title Plan LAN6093) and the purchaser will be deemed to have purchased with full knowledge thereof.

As to the tenancy and accommodation schedule in the auction catalogue, please note the following changes:

The rent for Suite A5 is £9,849.96 p.a.
Suite B3 Rear is now vacant.
Suite C16 is now vacant.
The lease of Warehouse 1 has expired but the tenant remains in occupation. No rent is being accepted so that security of tenure under the Landlord and Tenant Act 1954 is not obtained. Negotiations are ongoing in respect of a new lease.
. The current total gross rent is £272,140 p.a.(inclusive of the rent for Warehouse 1 – see Allied Business Park Schedule 8th July in the legal pack)

An updated tenancy schedule labelled ‘Allied Business Park Schedule 8th July 2015’ has been added to the legal pack and replaces all previous tenancy schedules. As this is an active asset management situation the income and expenditure can go up or down and therefore the information supplied is given in good faith but no warranty can be made by the Seller, the Auctioneers, the Administrators or their firm or any of its professional advisors as to the current gross or net incomes at the date of the sale. The purchaser is deemed to buy with full knowledge of this disclaimer.
A notice has been received from Lopian Wagner Solicitors. A copy has been included within the legal pack and buyers are deemed to buy with full knowledge thereof.
