ADDENDUM
To the Catalogue for
Auction Sale: 17 September 2026

All Lots
The purchaser of each lot is deemed to purchase with notice and full knowledge of the important notice to bidders, the Common Auction Conditions, where applicable, the special conditions of sale and this addendum.
The purchaser of each lot is deemed to have inspected the property and have verified the accuracy of all information given in the particulars including the extent of the premises to be sold and the floor areas. Additionally, the purchaser is deemed to have read the legal documentation.
The boundary plans in the auction catalogue are for identification only. The correct title plan showing the boundaries of the properties are available for inspection and the purchaser will be deemed to have purchased with full knowledge thereof.
Please note that vendors may require a supplementary amount to be paid by the purchaser to the vendor over and above the purchase price. Please check the special conditions of sale to ascertain whether this applies to the property for which you are bidding.
The Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 came into force on the 26th June 2017.
Under the Regulations, Acuitus is legally required to immediately undertake customer due diligence checks on the buyer and related parties.
Acuitus will need to receive identification documents that satisfy the Regulations for the bidder, the buyer (if different from the bidder), the beneficial owners with more than 25% of the voting rights or capital and proof of authority if the bidder is acting as an agent.
Acuitus will also need to receive satisfactory identification on the source of the deposit money provided by the bidder/buyer.
If you are the successful bidder, Acuitus requires a separate payment of £1,500+VAT as a buyer's administration charge payable to Acuitus Limited upon exchange of contracts. A VAT receipt will be provided upon payment.
The Common Auction Conditions have been updated as at February 2026.

As to the Accommodation and Tenancy schedule in the Auction sales particulars please note the following;
• Holland and Barratt, 40 Market Square, Heads of terms have been Agreed for Holland and Barratt Retail Limited to renew the lease for a term of 5 years from 3rd October 2026 until 2nd October 2031 at a new rent of £23,000 per annum exclusive. The lease will be contracted inside the security provisions of the Landlord and Tenant Act 1954 and will provide for a tenant option to determine the lease on the 3rd anniversary of the term.
• Card Factory, 28 Market Square, Heads of terms have been Agreed for Sportswift Limited to renew the lease for a term of 3 years from 15th November 2026 until 14th November 2029 at a new rent of £20,000 per annum exclusive. The lease will be contracted inside the security provisions of the Landlord and Tenant Act 1954.
• SpecSavers, 29 Market Square, Heads of terms have been Agreed for Specsavers Optical Superstores Limited to renew the lease for a term of 5 years from at a new rent of £18,750 per annum exclusive. The lease will be contracted inside the security provisions of the Landlord and Tenant Act 1954 and will provide for a tenant option to determine the lease in 2029”.

The lease dated 12 November 2007 between (1) Artisan Wicker Riverside Limited and (2) Priority Sites Limited under which the Lot is held (the ‘Lease’) contains the following definition of the demised premises “The Premises known as 48 parking spaces shown edged red on the Plan…”. The plan attached to the Lease, however, only delineates 46 parking spaces, being those shown edged red on the plan attached to the Lease. This is reflected on the Title Plan for title number SYK544002. So far as the Seller is aware, the spaces numbered 15 and 16 on the plan attached to the Lease which are not included within the red edging are not used as parking spaces and do not form part of the Seller’s title to the Lot.
The Seller is advised that an Energy Performance Certificate is not required for this property.
Correspondence with the Landlord regarding the Service Charge Arrears including a Debt Recovery and a s.146 Notice along with other documents have been added to the Legal Pack.
