ADDENDUM
To the Catalogue for
Auction Sale: 18 September 2025

All Lots
The purchaser of each lot is deemed to purchase with notice and full knowledge of the important notice to bidders, the Common Auction Conditions, where applicable, the special conditions of sale and this addendum.
The purchaser of each lot is deemed to have inspected the property and have verified the accuracy of all information given in the particulars including the extent of the premises to be sold and the floor areas. Additionally, the purchaser is deemed to have read the legal documentation.
The boundary plans in the auction catalogue are for identification only. The correct title plan showing the boundaries of the properties are available for inspection and the purchaser will be deemed to have purchased with full knowledge thereof.
Please note that vendors may require a supplementary amount to be paid by the purchaser to the vendor over and above the purchase price. Please check the special conditions of sale to ascertain whether this applies to the property for which you are bidding.
The Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 came into force on the 26th June 2017.
Under the Regulations, Acuitus is legally required to immediately undertake customer due diligence checks on the buyer and related parties.
Acuitus will need to receive identification documents that satisfy the Regulations for the bidder, the buyer (if different from the bidder), the beneficial owners with more than 25% of the voting rights or capital and proof of authority if the bidder is acting as an agent.
Acuitus will also need to receive satisfactory identification on the source of the deposit money provided by the bidder/buyer.
If you are the successful bidder, Acuitus requires a separate payment of £1,500+VAT as a buyer's administration charge payable to Acuitus Limited upon exchange of contracts. A VAT receipt will be provided upon payment.
The Common Auction Conditions have been updated as at February 2026.

In respect of the first-floor tenant (Due Diligence Checking Limited), please note that prior to marketing, the landlord offered the tenant a new 5-year lease with an upward only rent review at year 3 to open market value, at a new commencing rent of £12,500 pa plus VAT. The tenant has since proposed a new 3-year tenancy at a new rent of £9,600 pa, and an annual tenant break option within the three-year term. The property will be sold with the tenancies as existing & it will be for a Buyer to continue any renewal negotiations after completion of the sale.

As to suite 7, the lease renewal has now completed for a term of 5 years from 26/02/2025 at a rent of £15,000 per annum exclusive.
As to the Special Condition of Sale, for the avoidance of doubt, it is intended that the Seller will treat the sale as a Transfer of a Going Concern (TOGC) and G15 of the Common Auctions Conditions is applicable.

Please note that the lease renewal on Unit 3a has now completed, for a term of 3 years wef 8/9/2025 at £5,000 pa, with a tenant only break option after 18 months. The total rent for Lot 15 should now read £150,495 pa & not as stated and a copy of the new completed lease for Unit 3a is in the legal pack.’

The tenant is currently operating the property as a residential House in Multiple Occupation (HMO). The property falls under the jurisdiction of the London Borough of Harrow and not the London Borough of Barnet. The London Borough of Harrow have written to the Auctioneers confirming that the Local Planning Authority (Harrow Council) have not served a formal enforcement notice and not as stated in the auction sale particulars. A copy of the correspondence from London Borough of Harrow is available in the Legal Pack.
The Special Conditions of sale provide for the completion period to be 8 weeks from the auction.

The property is let to The Secretary of State of Housing, Communities and Local Government for a term of 5 years from 28 August 2025 until 27 August 2030 and not as stated in the auction sales particulars.

As per footnote (1) in the auction particulars, the new lease to the Dry Cleaners at 5 High St has now completed. The lease is for a term of 5 years from 1/10/2025 at £13,500 pa rising to £14,500 pa on 31/3/2027. The new lease is subject to a rent review & tenant only break option on 1/10/2028. The total rent therefore will rise to £18,300 pa from completion of the sale. A copy of the completed lease is available in the legal pack.

The residential upper parts are let to Homes 51 Ltd (crn12105910) for a term of 2 years from 1st March 2024 until 28th February 2026 at a current rent reserved of £42,000 per annum and the Ground floor Retail unit is let to Individuals for a terms of 10 years from 24th September 2020 until 23rd September 2030 at a current rent reserved of £900 per week equating to £46,800 per annum, with the Ground floor Retail lease providing for a Landlord option to determine the lease at anytime on serving not less than 6 months written notice and being outside of the security of tenure provisions of the Landlord and Tenant Act 1954. Therefore, the property produces a total rent of £88,800 per annum and not as stated in the Auction sales particulars. The tenant of the Retail unit is not currently trading from the property.
